I agree to the liability waiver

I, the undersigned, agree to this Release and Waiver of Liability (“Agreement”) on behalf of myself, my personal representatives, next of kin, heirs, successors, and assigns. I make this Agreement for the benefit of Skagit Land Trust, a Washington nonprofit corporation, its directors, officers, employees, volunteers, agents, successors, and assigns (“Skagit Land Trust”). This release discharges Skagit Land Trust with respect to any and all claims for bodily injury, illness or communicable disease including but not limited to Covid-19, property damage or death from any cause, including negligence, that may result from my activities with Skagit Land Trust.

Assumption of Risk. I understand that the activities I engage in while volunteering for Skagit Land Trust may involve risks including but not limited to difficult conditions, uneven terrain, unanticipated natural hazards, use of tools and equipment, and/or strenuous manual labor, inclement weather, limited access to emergency services, dangerous wildlife (bees, ticks, snakes, etc.) and risk of exposure to communicable disease. I undertake all such activities at my own risk and agree, for myself and my heirs, to release Skagit Land Trust from any liability for injury to myself and/or damage to my possessions, which may occur in connection with these Trustrelated service activities.

Photographic Release. I understand that a photographer may be present and that I may be photographed while volunteering. I agree that I will contact the photographer if I do not wish to be photographed. I hereby grant and convey to Skagit Land Trust the irrevocable and unrestricted right to use and publish photographs of me, or in which I may be included. I have read this Agreement, fully understand its terms, understand that I have given up substantial rights by signing it, and have signed it freely and without any inducement or assurance of any nature. This Release and Waiver of Liability is intended to be as broad and inclusive as is permitted by the law of Washington and that if any portion is held invalid, the balance shall continue in full legal force and effect.
